1. Introduction

Welcome to Mar-A-Montana Luxury Villa ("we," "our," or "us"). By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). These Terms govern your use of our website and any bookings or services related to Mar-A-Montana. Please read them carefully.

2. Eligibility

Guests must be at least 18 years old to make a reservation. By booking with us, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Booking Process

Reservations: Bookings can be made directly through our website or by contacting us via email at maramontana_jm@gmail.com or phone. A reservation is confirmed only upon receipt of the required deposit and our written confirmation.
Deposit: A non-refundable deposit of 30% of the total rental amount is required to secure your booking.
Balance Payment: The remaining balance is due 30 days before your arrival date.

4. Cancellation and Amendments

Guest Cancellations:
- Cancellations made more than 60 days before arrival: Deposit is forfeited.
- Cancellations made less than 60 days before arrival: 100% of the total rental amount is forfeited.
- Amendments: Any changes to your booking are subject to availability and may incur additional charges.

5. Check-In and Check-Out

Check-In: From 3:00 PM on the arrival date.
Check-Out: By 11:00 AM on the departure date.
Late Check-Out/Early Check-In: Requests are subject to availability and may incur additional fees.

6. Guest Responsibilities

Occupancy: The villa accommodates a maximum of 16 guests. Exceeding this limit without prior approval may result in additional charges or termination of the rental agreement.
Conduct: Guests are expected to behave responsibly and respect the property and neighbors. Excessive noise, parties, or any illegal activities are strictly prohibited.
Damages: Guests are responsible for any damages caused during their stay. A security deposit may be required and will be refunded upon satisfactory inspection of the property.

7. Payment Methods

We accept payments via bank transfer, credit card, or other methods as specified during the booking process. All payments must be made in USD unless otherwise agreed.

8. Changes by Mar-A-Montana

In rare circumstances, we may need to make changes to your booking (e.g., due to unforeseen maintenance issues). In such cases, we will notify you as soon as possible and offer alternative accommodation or a full refund.

9. Liability

We are not liable for any loss, injury, or damage to persons or property during your stay, except where such loss, injury, or damage is due to our negligence. Guests are advised to obtain appropriate travel insurance.

10. Force Majeure

We are not responsible for any cancellations or changes caused by events beyond our control, such as natural disasters, pandemics, or government actions. In such cases, refunds or rescheduling will be considered on a case-by-case basis.

11. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes arising from these Terms or your stay at Mar-A-Montana will be subject to the exclusive jurisdiction of the Jamaican courts.

11. Safety and Conduct

11.1 Swimming Pool Use:

Swim at Your Own Risk: Our swimming pool is unguarded; no lifeguard is on duty. Guests must exercise caution and are responsible for their own safety while using the pool.
Children under the age of 18 must be accompanied and actively supervised by a responsible adult at all times while on the property, including but not limited to the pool area, balconies, fish pond, and waterfalls. Active supervision entails maintaining visual and auditory contact, remaining within close proximity, and being prepared to provide immediate assistance if necessary. Please be aware that certain areas of the property feature uneven terrain and natural water features; therefore, heightened vigilance is required to ensure children's safety.

11.2 Fish Tank:

No Fishing: Fishing or tampering with the fish tank is strictly prohibited to ensure the safety of both guests and aquatic life.

11.3 General Caution:

Property Terrain: Mar-A-Montana Luxury Villa is situated on hilly and uneven terrain. Guests should exercise caution when navigating the property, particularly when accessing the waterfalls, to prevent trips or falls.

By adhering to these safety guidelines, guests can help ensure a secure and enjoyable experience at Mar-A-Montana Luxury Villa.
